These Terms & Conditions of Sale (T&Cs) govern the entire relationship between us, the company ART X POLLO OÜ (brand TOSSIT), and you, the customer of the website tossit.game. Still with us? Good!

1. Acceptance of the t&cs

When you confirm your order, you declare that you have read these T&Cs and accept them without reservation. If not, don’t click validate, just head to a shop and buy your TOSSIT game there instead.

You are either a natural person of legal age, or the legal representative of a company.

Are you a minor… and reading this?! Oh wow, the world has changed 🤨 (but good for you!). You can browse the site without a problem, but you CANNOT confirm an order without the authorization of your legal guardian. (sorry)

2. Placing an order

You guarantee that the personal information provided in the order form is accurate, up to date, and truthful. It binds you and serves as proof of your identity.
After validating your order (meaning payment is accepted), you’ll receive a confirmation email containing:

• a summary of your order and the estimated delivery time
• a link to the T&Cs (in case you want to read them again, for fun)
• a link to download your invoice

3. Prices and payment

The prices shown include VAT, regardless of the European country. We reserve the right to change them as we see fit. The cost of delivery is included for some countries, or the amount will be indicated before the validation of your order. 

Full payment is required to place an order. That's right! We entrust the management of payments and their security to our long-time partner: Stripe. (they also handle deliveroo, booking, etc. it's pretty secure). We do not store your bank details, so you will need to enter them each time you order. 

In the event of a payment default or incident, or attempted fraud in the use of tossit.game, we may suspend or cancel any order and delete the account if necessary.

4. Delivery

We deliver in Europe, in Switzerland, in the United Kingdom, and around the world to the address indicated at the time of your order as "delivery address" (which may be different from the billing address).

The tossit.game website mentions, for each product offered for sale, indicative delivery times according to the territories and delivery methods. Delivery is made within the time period indicated in the order confirmation email. If ever (still here? we almost lost you) the stock is zero, nada, nothing, when you order, it just means we’ve been victims of our own success 🤗🤗. You’ll need to wait for restock before we can give you a delivery date. 

If shipping is delayed by more than 7 business days (a stockout does not count as delay), and your product(s) haven’t been shipped, you can request a refund by emailing support(at)tossit.game. If the order was already shipped before your email arrived, we’ll refund the product(s) (excluding shipping fees) once we receive the unopened package back in perfect original condition.

IMPORTANT, it is your responsibility to check the good condition of the parcel and the products when they arrive. Take photos before opening if necessary (afterwards it's too late) or refuse the package if it is likely to have been opened. A bit of common sense: we're talking about silicone parts that you'll be throwing around, don't overreact either 😏. Send your complaints to support(at)tossit.game.

If the chosen carrier is late, we cannot be held responsible. Relax, it will be fine. ✌ Same thing if they lose your order, but we'll do whatever it takes to fix it super fast!

5. Right of return

You can withdraw from your order without giving any reason (snif 😥 ) within 14 working days from the date of receipt of your order. Notify us by email at:

You’ll receive an acknowledgment with the procedure and a prepaid return label.

We only refund the price of the products, not transport costs (both outbound and return). Why? Because every unnecessary round trip pollutes, costs, and makes our parcels travel the world for nothing.

Refunds are issued no later than 14 days after receiving your request, via the same payment method used for the initial order. We may delay the refund until the product(s) are received.

Products must be returned new, in their original packaging, within 14 days of the acknowledgment being sent. You are responsible for any loss of value caused by improper handling.

You may also request an exchange. Same procedure and timeline apply. If we don’t have the requested item, we’ll let you know by email.

6. Cancellation of your order

We do have the right to cancel your order and we will use it for any of the following behaviors:

• You are being disrespectful to one of our team members.
• You degrade our image online, you write comments on social media that do not reflect reality (we'll go beyond and sue you, no joke).
• You insult us. No refund, we’ll keep the full amount in compensation.
• You intend to use our products in a way that could degrade our image.

7. Legal guarantees

You benefit from a 2-year legal guarantee of conformity which allows you to ask us to repair or exchange the defective product(s) (normal wear and tear not being a defect), or failing that, a refund. In France, Belgium, Spain, Luxembourg, Italy and Romania you benefit from the guarantee against hidden defects. You have 2 years from the discovery of the defect to act, you will have to prove the hidden defect, by an expertise for example. 🧐

Products must be returned new for inspection. If the defect is confirmed, we’ll first try to send you a replacement, otherwise we’ll refund you in full.

8. Your responsibility

You are a grown up, you are responsible for the use of our products and the use of the tossit.game website. We don’t recommend starting a game on a police car 🚔, but hey, do as you wish. We won’t be held liable. 

Be careful when paying online, don’t do it from a public computer. If some hacker installed a script to steal your banking info, you’ll be crying. Always check for the padlock on the left side of your browser bar when paying, the site is secure.

You use this site at your own risk. Sounds scary, but you get the idea, you’re solely responsible.

9. Our responsibility

We make every effort to have the tossit.game website accessible 24/7 and secure. However, in the event of force majeure, malicious acts, possible breakdowns of hosting providers, technical difficulties and slightly longer than expected maintenance periods, access to the tossit.game website cannot be guaranteed.

We reserve the right to change absolutely everything on the tossit.game website except your customer account and personal information. In case of suspicious behaviour, we may close your account after having justified this closure by email.

10. Intellectual property

TOSSIT is a registered trademark belonging to the company ART X POLLO OÜ. Let's make it simple, the slightest act of reproduction of the slightest content of this site without the written authorization of one of the active members of the team is quite simply forbidden. We will not hesitate to take legal action if necessary. Come and talk to us, it's so much easier, we don't bite.

11. personal data

We respect your data like you respect your favorite darts 🎯.
When you place an order, create an account, or subscribe to our newsletter, certain personal info (name, address, email, payment details) is collected.

We only use it to:

• process and deliver your orders,
• send you invoices,
• answer your questions,
• improve our services (not to spam you unnecessarily).

Your data is processed in accordance with the General Data Protection Regulation (GDPR). It is stored only as long as necessary for order management and legal obligations, then deleted or anonymized.

12. Links and third party sites

Again, let's be very direct, if you click on a link that takes you out of the tossit.game website, what you do on that third party site is absolutely none of our business, and we will never be held responsible for anything. On that note, happy surfing 🏄.

It is strictly forbidden to monetize all or part of the access to the tossit.game website, as well as the information it contains.

13. Changes to the t&cs and language

We reserve the right to change these terms and conditions as we see fit (as you can imagine, we get a kick out of it #worstjobever). The applicable conditions are those in force at the date of your order.

The language of interpretation is French (yes, you read it well, le français).

14. Applicable law

If you have a problem with your order, please send us your complaint first and we will find an amicable solution: support(at)tossit.game.

Alternatively, the European Commission has set up an online dispute resolution platform: https://webgate.ec.europa.eu/odr/.

These T&C are governed by Estonian law.

In the absence of an amicable solution, and regardless of the origin of the dispute, disputes relating to the execution or interpretation of these T&C shall be submitted to the competent courts of Tallinn.
