THE TOSSIT AMBASSADOR PROGRAM - TERMS AND CONDITIONS

1. Introduction
This document details the terms and conditions ("Terms") governing your participation in the TOSSIT Ambassador Program ("Program"). By signing up for the Program, you acknowledge that you have read, understood, and agree to these Terms.

 

‍2. Eligibility
To participate in the Program, you must:
Be at least 12 years of age. (under 18, your parent or guardian will have to fill in the sign up form with you, and they will also have to provide their IBAN to payout your commissions)

 

‍3. Ambassador Role
As an ambassador, your role is to promote TOSSIT games and encourage sales through the use of your unique ambassador code. Your promotion should always be in good taste and truthful.

 

‍4. Commissions
Commission: You will receive a 17% commission on all sales made using your unique code.
‍View-Based Incentive: For every video you create that garners views, you earn €1 for every 1000 views once your video surpasses the 10k view mark on TikTok, or the 20k view mark on Instagram. TOSSIT reserves the right to veto videos in order to prevent any attempt to manipulate views, or the use of tools or services designed to greatly increase the number of views.
Sales-Based Bonus: For every 30 sales made using your code, we'll reward you with a free TOSSIT game. What you choose to do with this game is up to you; host a giveaway, gift it, or keep it for personal use. Just provide us with the shipping address, and we'll handle the rest.
Initial Purchase Refund: If you purchase a TOSSIT game to create content, we will fully refund the cost of your purchase once you achieve 10 sales using your code. Please note that the email address associated with your purchase and your ambassador account must match for this refund to be valid. Inform us once you reach this milestone to claim your refund.

Commissions will be paid out once they reach a minimum amount of €10.
Payments will be made through bank transfer and handle by our trusted partner STRIPE. You will be ask to provide them your information.

‍5. Code Usage
‍Your unique ambassador code provides a 10% discount to the purchaser and should only be shared in connection with your legitimate promotional efforts. You are strictly prohibited from sharing your ambassador code on coupon websites.

 

‍6. Ambassador Conduct
‍You agree not to engage in any false or deceptive behavior in connection with the Program. This includes, but is not limited to, creating fake orders to generate commissions. You must comply with all applicable laws and regulations, including those related to advertising and online conduct.

 

‍7. Termination
TOSSIT reserves the right to terminate your participation in the Program at any time for any reason, including but not limited to a breach of these Terms. Upon termination, any unpaid commissions will be forfeited.

 

‍8. Intellectual Property
By participating in the Program, you grant TOSSIT a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display any content you create as part of the Program for marketing, promotional, and other purposes.

 

‍9. Limitation of Liability
TOSSIT will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to the Program. The total liability of TOSSIT, whether based on contract, tort, or otherwise, will not exceed the total commissions paid or payable to you under the Program.

 

‍10. Changes to the Program or Terms
TOSSIT reserves the right to change, suspend, or terminate the Program or these Terms at any time for any reason. Any changes will be communicated to ambassadors in advance.

 

‍11. Governing Law
These Terms are governed by the laws of Estonia, without regard to its conflict of laws rules. Any dispute arising out of or related to these Terms or the Program shall be subject to the exclusive jurisdiction of the courts of Tallinn.

 

‍12. Entire Agreement
These Terms constitute the entire agreement between you and TOSSIT with respect to the Program and supersede all prior communications, agreements, or understandings, whether written or oral.

 

By signing up for the TOSSIT Ambassador Program, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
